Ordered some parts for Dads new PC and the package had all the items. But also an additional one not ordered so for "free". I figured ill give it to my brother or something.
Now they sent me an email saying to mail it back or pay for it, but can they actually do anything about the situation? I dont even live in the same country as the company. Probably gonna send it back but i didnt like the tone of the email they sent considering i dont think if its already in my hands that they can do anything about it.

If you told us the country we could help you more . European law generally states that anything mailed to you without consent is yours to keep.

In the 80's & 90's a lot of mail order companies pressured people into paying for stuff by mailing them "follow-up" 'gifts' after a cheap "welcome" package. You know the stuff: get a little figurine for next to nothing and then suddenly they send another one the month after for €20 and then start threatening with lawsuits if you don't pay up.

This kind of practice got outlawed by this new law that makes everything mailed to you without you having signed up for it, your property by default.

You should be covered by law on this. If you don't care for the company: keep it as a fuck you for their tone, otherwise send it back (with them paying for postage ofcourse).

If it's already used, then don't send it back. Don't even answer their email, do NOT acknowledge that you received the item OR deny it.

Basically, ignore any and all correspodence.

This.
If it was some shop, where i regulary order from (like Amazon) i would definately give it back.

If the email REALLY was written in a bad tone, i would just keep the shit.

Amazon actually mailed me the wrong item once and when I contacted support, they told me I could keep it Laughing . I mean, it was completely the wrong item - not at all related to what I had ordered so probably a label mix up.

Yeah Amazon are nice fellas, their customer support is usually pretty decent also (compared to the alternatives around). Razz

Part of me would say this, but I know that the other one would feel bad about it so in the end I'd return it Sad
Though I too believe that keeping the item shouldn't lead to anything compromising really, since it's the company's fault to begin with (and they obviously are aware of that, they're just trying to intimidate you Mafia-style Very Happy)

Yeah they fucked up. They probably work with a warehouse that ships hundred if not millions of items every day, so mistakes can happen.

But my question is was it so hard to just do the right thing and notify them of the incident when you noticed it, instead of going all "jeah free gudz! profit" ghetto?

I would understand if you would have done that and they would have demanded that you pay for the shipping cost on the returned items. In that case, yeah fuck them. But that clearly is not the case. Laughing

I hope they sue you, because you sound like an opportunistic asshole.

And they just might:

Quote:
"In any legal action the ruling is likely to be that the item should be returned because it was sent in error," the company concluded.

Yes poor companies, they sure don't have any insurance at all to cover these mistakes. Razz
They are as opportunistic as anyone out there so why feel sorry?

You get screwed enough in life, might as well take your bit if it doesn't hurt anyone.

if they send you more items then you ordered -> how could they know that and mail u? but its their fault, they cant force you to bring it back to the post office. if you want to answer -> just say if they pickup they could have it back Razz but you wont be able to order in the future from them

this happened a lot with mindfactory in germany about two years ago, they didnt even noticed that. a friend of mine received an extra mobo + additional ram with one shipping (and a lot of people experienced same things). he kept it cause they didnt mailed him about it. afaik in germany (and mostly europe) -> if you receive a package on your name and adress with stuff you didnt ordered you can keep it without to pay for it (ofc its different if someone fucks you up by ordering on your name and address and a bill is included)

Honestly I don't know. But it might be that someone, most likely some minimum wage warehouse operator, is held responsible for the mistake. Maybe I'm being naive here, but I couldn't accept that outcome, because I'm too lazy or opportunistic to notify and do, what imo, is the right thing. Again, that's if they are willing to cooperate and support the shipping cost, for what ultimately is their mistake. If not then yeah, I did my part, so fuck them.

If anyone should be blamed for this, it's the responsible worker at the company.

Which shop was it?

If a bank accidentally transfers a million bucks to your account you have to return it.

If you find a brand new sealed product that doesn't belong to you AND you have their contacts you have to return it.

The law will be on the store's side. If it was a used personal item then it could possibly go as finders-keepers otherwise you're just stealing.

Both of your examples are not what has occurred.
