Could be multi-part dude, you don't know.
Who's the say they can't detect it, but it still requires game code to block it at run time? If they can detect it, doesn't matter if the game blocks you or not, you'll get a nice ban.
I'm not saying I'm right either, just saying, stop making such definitive statements, no one knows for sure.

You obviously don't know how this work. They ban to boost sales during the busiest time of the year where they will make the most sales. Thanksgiving is the time of the year where they sale the most stuff. So a ban before Thanksgiving will automatically boost their sales through the roof.
Look at every year they made a ban wave, its always a week or two before Thanksgiving.

Anyone know if it'll be alright to play pre-AP25 games online before the banwave? Specifically thinking Super Street Fighter 4 and Alan Wake.
I realise that it's never 100% safe, but if the games are pre-wave 7 and stealthed will I have a decent chance of surviving?

maybe LT was really safe and MS was screwed and didnt find a way to flag people these years ? Would be funny, although I stayed away from XBL ever since i got banned last year and eventually bought a jtag to get all my xbox live content i ever wanted !

I think they won't do a massive ban hammer like last year. Again we don't know. The only one that knows is microsoft.

Ok, so I have an OLD 360 (with VGA only) and my friend flashed it to make it play backups (not sure what firmware it has). If I want to play backups I just put it an Wave 4 boot disk, and after it loads swap it with the backup I want to load. Is it safe for me to update to the new dash? Will the new AP25 checks kill the Wave 4 boot disk from loading backups?

Not necessarily. It might be an Hitachi on 1.51 in which case he/she is ok.

not if u have a lite-on, they come in different versions, which can be only identified by a sticker on the drive itself

To be fair, opening the 360 is one of the easiest tasks in the entire world, it's fucking awesome they made most of it snap apart!
Taking the 360 apart is a complete breeze, and requires no special tools until you're inside and you need the torx shit inside, and even torx is pretty common!
