Don't confuse the discussion, the burden of proof is on you to proof that Microsoft have NOT broken any laws when it comes to the tampering with the machines so that you cannot use certian functions like arcade games paid for, backwards compatibility etc, the banning of Xbox live contract is dubious at best.

Arcade games still work if its the console they where bought on and now your saying them banning you from xbox live is dubious . WTF they can't ban you from live ?
They haven't broken any laws , physically your machine is the exact same. All Restrictions are imposed by the Software which you agreed they have the right to modify when you first signed into live.
fuck sake When you actually put a functioning backup in you have broken the DMCA as well in the states.

Guys, please stop quoting this imbecile. Every time I see one of his posts it saddens me to know that there are people as thick as he is out there. Particularly now that I know that he's 35. If that's really true and this is how he behaves then I believe he should be in care. He's clearly got the mental age of an early teen at best, and that mixed with someone who exibits such aggressive traits can be very dangerous in an adult. It's probably best not to provoke him. He might end up hurting himself, or worse...someone else.
It's not his fault. He's been failed by the system.

It's funny how personal people go in this thread.
I'm not on M$ side, but I also think that as they have the power to ban you and the EULA gives them the 'right' as long as no-one goes to court to say that their EULA (in addition that it's not law) actually gives them a right to break law (if they actually modify the box by sending a signal which causes the box to burn a NAND-gate or something). AND wins the court, there ain't really anything people can do and Microsoft hasn't done anything wrong in the eyes of current laws.
Like history, laws are in the hands of the winners (of the court cases). 
This thread should be more civil, less about personal attacks, more about... Microsoft and the lawsuit.

ms has crossed the line this time. the fact that a lawfirm is even considering taking on the might of the giant is testament to that fact.
if those goes through in europe, most likely, ms if fucked and we'll see a u turn. however ms will fight it for years and the next console will be out.
it's time games companies got real and started to charge a reasonable amount for thei games £5 to £10 and sell them online, no mechanical sales needed, therefore no stock to dump if something doesn't sell, and I and many other so called 'pirates' would buy a lot more games. the business model is fucked, same with cd's. Games don't cost any more to make than a movie, yet we don't and won't pay £40 to see/own one.
No advertising.

Well, my Xbox live games I bought have reverted to being trail games backwards compatibility has gone.
To regards to the " contract " its actually an agreement not worth the virtual paper its written on and the law firm knows this. |

Just a side note: Steam also does this. There was the thread here just a while ago where someone got banned from steam (luckily for him he got the account back) thus leading him to lose all the games he had legally bought from Steam.
It's totally wrong, but unless enough people gather up (or some f-ing rich bastard stands up) nothing will change. So actually, maybe there is now enough people gathering up for this case to get something done.

Quite honestly I couldn't care less if it succeeds or not, I wasnt even arguing the point apart from that this case isnt as petty as the three you stated, and I felt what Microsoft have done was overstepping the mark and that there could be a case for illegal activity.

I've only seen one person explicitly say its "illegal". I do not understand how anyone can see the act as anything but aggressive and potentially liable for (in court at least). No, purchasing another console should not be an option. As has been stated - countless time - banning from live is a risk anyone takes when modding their consoles for ANY reason (and as someone pointed out there is more to modding than playing pirated games); the loss of functionality for a purchased piece of hardware. . .thats something else entirely.
What this is effectively saying, is that MS (and really any corporation) has the ability to hobble the software on your piece of hardware - sure you still own the hardware, but you still "lease" the software from MS and they are saying "It's time to pay the piper". That, is a pretty amazing position to take, and I am surprised anyone here - who so vociferously howls at the thought of DRM - is totally and completely fine with this.
