my motherfucking roomate and motherfucking pieces of shit producers of a piece of shit polish movie with score of 4/10 with piece of shit motherfucking sad actors.

I rent an apartment and the deal with ISP is on me, while my roomates use it.
yeah, so... Today I've got a letter from a law firm that if i don't pay them 550 zł (~150-200$) they're going to sue me for downloading a piece of shit movie. The thing is that I don't watch piece of shit polish movies because they're so motherfucking bad but my roomate is a motherfucking retard and he does.

At first I thought it's a scam and that they can blow me. Well, i've read into it and it's not a scam and the case is already in public prosecutors office. It's most likely they'll drop the case (or so i've read), but also they might not and police might knock at my doors to confiscate all my computers for very long. That's the worst part actually, because i'm like a mass-murderer that is about to get caught for the murder he didn't commit (i really need to clean the crime scene: c:\ d:\).
So that's something I CAN'T avoid. What i CAN avoid by paying them is that they won't make an ADDITIONAL law-suit (private or something) against me.

The good part is that my roomate is a fucking complete retard and he read the letter and he thought the IP there (router's "external" ip) is his IP and he shit his pants so he confessed to me. So he's ready to pay, so that's something. He wanted to split the 550 zł because we (me and my other IT roomate) download from p2p too. I told him some bullshit that we encrypt our torrents and we use TOR and we're not as retarded as he is (we are, and most of you probably are too).

So... I don't give a shit about going to court because i'd probably win that one. I'm REALLY innocent and they've got shit on me. I'm shitting my pants about the thought of police raiding my house though. I really need to clean everything and buy a usenet account.

guys.
1. don't do p2p.
2. don't download movies with <6 imdb rate.
3. don't have retard roomates (it's not his fault because even all my family wears the black flag but he got caught and i don't like him)

tl;dr:

i've got a letter that says I have to pay money if i dont want to get sued for a movie my rooomate leeched.

Is sub-renting legal in Poland? Do you have a contract with your roommate? Because that could be another problem if (and this is a big if) you go to court for the copyright claim. If it is legal and you do have a contract, it would be their obligation (the movie industry fuckers) to prove it was you doing the download, which they can't obviously, as you would just say it was someone else. But if you can't prove you legally have a roommate, I think they could hold you responsible for the download anyway...

So you either pay them (maybe safer, especially because your roommate is willing to pay), or wait and see (they probably won't do anything, I don't know how things are in Poland regarding this matter, but a lawsuit isn't cheap and one shitty movie download is practically nothing).

Also, you need to make sure that by paying them you're not admitting to be guilty, and that they absolutely won't sue you.

1.Sub-renting is most probably legal but I didn't do it beacuse I trust my roomates. Well, now it looks like I could use that contract.

2.I could though have my WIFI unprotected AND I actually did share my wifi with neighbours for a long time.

3. Well, the roomate's parents are going to pay a visit to a lawyer so he's probably going to tell them not to pay because:

So, as probably the lawyer of my roomates parent's going to tell them not to pay all I have to do now is clean my computers and wait..

Had that happen when I still lived at home 5+ years ago, and even back then I already downloaded from usenet. My sister didn't though, and we got a letter like that because she downloaded mp3s from bearshare

We had our lawyer draft something up and answer them; never heard back from them again.

Good luck man, get usenet and share the cost with your roomates and allow them to use it too. Maybe even set up a centralized server, this could benefit all of you.

i pretty much expect the same outcome. It's probably impossible to sue like 100 000 people for download for one shitty movie.

i have my roomate admitting to downloading this shit in a message on fb if he decides to leave me with it. don't know if it's any credible though.

of course it's a scam but on supported grounds.
Some firm in germany listened on this torrent collecting IPs and they handed them to the prosecutors office and that's how they could contact my ISP for my personal data.

A lot of articles support the same info: there's really such case in the prosecutors office, they don't know who's it against and what does it contain.

i'm pretty relaxed by now. I'm only angry with my roomate because I don't like him. I don't know a young person that doesn't download from piratebay - it's just too easy these days. He was just unlucky and he has a veeery shitty taste in movies.

Oh fucking throw the shit away they aren't going to do shit.

I've gotten 4 letters from my ISP about that shit and the law firm wants money. They set up a site as a scare tactic so if you check it out you get scared to go to court to because of the fees and shit so you end up putting the money in their bank account. They aren't going to spend the time and money to find you, come to your state, take you to court over some money that they probably aren't going to get.

I'm fucking American so if it's bullshit here, it's most def fucking bullshit there.

Do what I do: create a Truecrypt file for illegal stuff. When you turn off your PC, it will close and become a single file. Name it something random and put it between system files and the idiots won't know what it is. Best thing to do, is put it in the root of a second or third drive and name it "hibernate.sys". Even IF they try to open it, they won't be able to tell it's Truecrypt. Basically, they won't have any evidence against you.

the way I see it is I can name it WarezXXXFreeGemz.exe and just don't tell them what's the password because i don't have to. I could forget the password.

I intend to clean all my computers, throw all my cds in a couple of days.

Look this won't ever go to court, any European judge will laugh them out of the courtroom. Persecuting private individuals who only p2p download like normal people is absolutely not-done. They like to call this proportionate measures. The only people they will actually take to court are people who are sharing terabytes and actually actively upload (IE mass seeders etc).

EDIT: Then again this is Poland, eastern Europe has its oddities. Laughing

(To Polish people? To Poles??, do you call Polish people Poles in the first place??? - Actually I think it's Pollacks - Polacker in Swedish - or some such term, I probably spelt it wrong but auto-correct in the browser didn't complain.)

(Prosecuting some lone individual won't really give much either way unless as stated above he's sharing tons of data - or selling, that usually gets them really active - so they can sue to tons of money or however it works in today's media industry.)

Downloading movies/games/mp3s is legal in Poland, sharing is not.

If you use private trackes, Usenet, http downloads, P2M etc, you're safe.

If you download shitty Polish movies on TPB, there's a slight chance you'll get in trouble.

For what it's worth, I download all my TV series from TPB and never had any trouble, so what you're faced with is probably some overzealous law firm Laughing

I would ignore the letter if I were you. Wink
