I think the use of mp3 here is to demonstrate the smallest amount of data to get you busted.
The law itself refers to a "work", so any copyrighted material will do.

well, i guess this says a lot about the stupidy of some americans (my general oppinion about americans is good so it's nothing personal).
but what the hell, my countrys president is in good relation with Bush .... wouldn't be surprised to see this things here also ...
