I bought my 360 here in Israel at March last year. I modded it around Aogust, and still no ban for me.
I rarely play online, however, I did so a few times...
So here goes the "modded out of the box" theory down the drain.
I'll see what's happening, at the moment I'll get a ban ( If I will ) I'll post.

Bare in mind though guys that these bans havent been rolled out en-mass some people have been using live and got banned a while after others got banned, to say my theory is wrong because you havent yet been banned isnt the way to disproove it the way to do that is for someone to get banned even though they have only modded the console straight out of the box only then is it disprooved.

Have a banned one, brand new, modded out of the box before even powering up, then never changed since. If you haven't been banned yet they just haven't got round to you.

So, its the same deal with XBOX original. You can chip the machine, then go live, no ban ever. In your case with 360, can you still play backups online??

I can go on live with backups (am right now with Test Drive Unlimited actually)
Same goes for a mate of mine the only thing our xboxes have in common are the fact that I modded them both as soon as they came out of teh box brand new having never been on live and we have both been on live with gold accounts ever since and still now, niether of us downloaded the Halo 3 beta either.
Both 360's have samsung ms28 drives and are using stealth 5.2 firmware.

I couldn't log in and got redirected to the network-test which told me that I abused the Terms of use and got banned. |

I just booted up my 360 and connected to Xbox Live, no problem, it works perfect, so I think i'm not banned yet although I've flashed the DVD.
TS M28 drive with Xtreme 4.2b firmware, flashed before fall update, and I've been on Live before flash.
I play mostly offline, but since last time I played over Xbox Live I played a backup of Gears Of War.

Isn't it possible to flash the drive when wanting to play back ups and reflashing it to the original to go onto xbox live?

Will it be safe for the users to flash with Xtreme Online if they previously flashed with others versions of Xtreme and they have not been banned?
We do not know that, it could happen or it couldnt happen. It could be too late if the user is already in the logs. But when the drive is flashed with Xtreme Online, it would be possible to call Microsoft complaining that the ban was not justified so they dont ban your console and there is no need to buy a new one.
So thanks to Xtreme Online we have a little hope for the ban to be removed?
Apparently yes they re-scan the console if you complain to the SAT.
Briefly, how does the Xtreme Online FW work?
Xtreme Online will emulate the exact speed and timings of the original games, and will protect the users against executing backups without stealth.
We must be careful with Xtreme Online?
The users must have well-taken care of not to flash the drive using the power supply of the unbann console. They should not play games before they leave the region.

so really, the new firmware is good for unmodded consoles only. One thing I liked is the manual banning process. Obviously they are looking at people who spend a lot of time on live with modded consoles as opposed to someone like me who is connected at an average of 30 minutes per month. Somebody up there must be looking at my logs and saying, "oh we are just glad, he bought the 360...thats the only money we are getting out of him!!!"
I am going to stick with the old xtreme firmware till I get banned. The ixtreme seems like a step backwards as far as features are concerned.

Yes and no, depending on how hard Microsoft is striking down on modified consoles. But I am going to upgrade from 5.2x to the new version to see if I was spared - which I doubt, but still worth a try. |

How the hell can you sue someone for not offering youa service. They give you a refund for your live account when you get banned so i'm not sure what grounds you have. Seems like a silly idea and all talk to be honest.

All the people claiming that people who arent banned yet will be are just people that have been banned and dont like it that others arent. Everything any of us say is just specualtion as none of us (including c4eva) know anything for certain, I know this much if you offer me free games or shitty wankermamey xbox live I'll take free games everytime, if you have a decent pc online console gaming just seems dumbed down and you cant see why people pay for it I certainly cant give me free online JOPS or UT on my pc anyday and I'll enjoy my free Gears Of War and GRAW2 on my 360 banned or not, incidently NOT! lol.
