Server logs aint enough, it doesnt prove anything. Anyone can be downloading through your computer just like anyone can have used your car in the bankrobbery. Thats what court here have decided, if APB want to charge you with downloading/uploading they have to prove you are the one downloading/uploading and not just that its your computer being used for it. |
I really hope what you say is true, but isnt that strange? Like if i stole something and then when the police came to me and saw the stuff then i just say that it wasnt me who stole it and they cant do anything.
Now we should not get in to if downloading is equal as stealing because that is not what i mean, its just a comparison.

Well if you have the things on you then you need to get up with a very good explination on how it got there from the theif without you noticing it. Probably you cant get up with a realistic enough reason so it wont help.
But that you car was stolen and youve reported it then ofcourse they cant arrest you for bankrobbery, you might be main suspect though. Same with downloading, they can se it went through your computer but cant prove it was you so you can only stay as main suspect until they can prove something.

Basically it's one guy telling the MPAA about guba.com which is a NG provider of sorts. This is one quote

"It's our understanding that Guba.com is committed to using 'Johnny' to filter MPAA movies on their network," the spokeswoman said. "They've been working with us in good faith, and they'll continue to do so. We have a relationship with Guba, and they have a commitment into making sure that they don't offer copyrighted content. We'll continue to monitor the situation, and if for some reason it doesn't happen we will talk to them." |
The MPAA knows about NG but in some sense they don't seem to care. I wonder if money is changing hands somewhere because it's hard to believe this next attitude.

It makes you wonder. Why haven't they gone after Giganews, Easynews and other providers when they know people are exchanging files that way. Could NGs be just too powerful to stop because they have money to fight unlike the average person or maybe that money is changing hands somewhere so that the MPAA and RIAA look the other way. Either way it goes i think NGs are much safer when it come to downloading.

Nothing has happened because they can't do anything. Newsgroups are in the public domain, they always have been! They have been around since before websites and they wont be stoped by an american company who want to stop the piracy of the world, it just isnt going to happen.

I don't see why newsgroups should be safe. I mean everyone who is leeching off newsgroups needs an account (if i'm not mistaken?), and you login with that, so it's quite easy to check logfiles for your down/uploads. Since most people pay for their account with a cc they also have the real name and address within minutes. And i'm sure someday a judge will order one of those providers to give the authorities access to the logs.

Why would they provide them if only to keep logs of what you download, they provide them to ease their bandwidth costs. I feel a lot of paranoia in this thread.

?? I actually reverted to Usenet becasue maintaining my ftp access took to much time. I dont contribute anymore, so Usenet it is.

I personally use FTP's but anyways, the whole point of NG's I thought they cant track what you download but how much you download. After all, alt.BINARIES....

On a related note, giganews just added SSL to their service. So no probs of intercepts. Of course giganews could give info, but they dont keep logs and aren't required to do so. Until the law changes of course.
