Well...wouldnt it be the same as attempting to break into someone's house?
Just because you attempt to break into someone's house and fail, doesnt mean you havent done anything wrong.
Come to think of it, Ive never heard of an attempted robbery charge. Max, is there such a thing?
But yeah, I'd say trying to forcibly gain access to something that is not yours and not allowed is illegal. Still, I dunno what anyone could do about a hotmail account if you got in...the most they could do is report it to Microshit.

I guess it depends if you cause damage to the property. If you do of course it's a crime, otherwise i'm not sure.
I'm almost certain that what watergem is on about isn't illegal though.

well il say it now. I guessed someones gmail account who i know, and from there i found details to other accounts. I didnt really do any harm, and i gave the guy his account details back etc told him to change the pass. But what im wondering is he says hes gonna take it further. But im unsure on what he can really do about it since there is no direct law im aware of that says *do not guess other peoples gmail account passwords*. :/

What proof has he got that you entered his email illegaly...Personally i wouldn't be worried about it...So you guessed his email password so what as long as you didn't delete or change any of his details he can't do shit.

well i used his emails inside teh inbox to gain access to other sites, and took a screenshot to show him inside his inbox as prrof i was there. it had my name on it too :/

Why would you do something like that?
Thats like breaking into a house and then leaving a note with your name and number where they can contact you...
if your gong to do something borderline illegal or something that is punishable, dont bait yourself out man

right il explain the whole thing now instead of giving you bits.
A guy who i know online and have for quite some time was pissing me off greatly, so i decided for a laugh id try to guess some of his passwords. little did i know id get lucky, and i got his hotmail account. From there i found gmail details and got that too. i took some screenshots etc and wrote on them to send to him. I thought he would see the funny side but instead he went nuts, threatened legal action and blocked me.

I don't think anyone would find it funny if another person has maliciously gained access to what they consider personal material. I don't know what you were thinking.
As for the legal action, well i just think thats bullshit he's come up with to try and scare you.
Syco, he wasn't brute forcing the account, at least not in a programming way. I don't think it counts.

yeah i meen surely, i mean a 5 year old could click *i lost my password* and guess someones password and view their details, right? i mean how can it be illegal, its like having a law that stated you have a 3 digit code to enter your vehicle and u must leave a glass box outside ur house with a clue to your keycode in it...

Just because I leave my car door unlocked and the keys in the ignition doesnt mean you have the right to take it for a ride. Know what I mean?

Also im pretty sure hotmail says it up to you and none else to keep your password for you self only.

1.—(1) A person is guilty of an offence if—
(a) he causes a computer to perform any function with intent to secure access to any program or data held in any computer;
(b) the access he intends to secure is unauthorised; and
(c) he knows at the time when he causes the computer to perform the function that that is the case.
so.. how am i coming under this when i didnt gain access to his PC, merely his email account on a public email interent service?

Dude, Im confused.
You guessed the password of an email address of a friend, didnt do anything harmful, told him what you did and now he wants to press charges?
I'd tell him to shut the fuck up and thats it. Even if he did call the cops, do you really think they are going to come arrest you because you got into the guy's email account and didnt do anything and were nice enough to tell him you did and maybe he should change his password?
The cops have better things to do with their time.

Trust me m8..I've had a few dealings with the police and something like this ain't exactly top of there agenda (NOT IN THE UK ANYWAY) i'll be very surprised if they even knock on your door...If they do call on you it will only be to say they have looked into it but what ever you do don't open the door as you will have to explain yourself...Do you still live at your parents house..?

The secret question was for him, not you. You didn't have authorization to open his email account, and he doesn't know what emails you may have opened/what personal information you've discovered. The moment you start trying to guess the guy's password, you're guilty of attempting to hack his account. Furthermore, he has proof, thanks to your pictures, that you KNEW you were doing something wrong. Finally, you've left an electronic trail back to you unless you've taken steps to prevent that. If he alerts hotmail/gmail and they have an IP that isn't his, and you've left a trail back to yourself, it wouldn't be hard for whatever cybercrime force in your country to track you down. I have no doubt that hotmail/gmail would assist the police if they decided to take action. This isn't the most serious hacking case out there, but you've likely left yourself open for problems. It was a stupid move but hopefully you've learned your lesson.
