The only logical conclusion is that Take Two has something on them, something that TR felt was, at the very least, sufficient to allow a court case. Even if Take Two didn't win, they could afford to bleed TR through prolonged legal action, assuming they had enough to convince a judge not to throw it out in the first place. And perhaps TR felt said leverage was even sufficient for Take Two to win such a case, in which event they might be on the hook for multiple millions in damages. Perhaps there is some quirk of UK (isn't that where TR are based?) law that Take Two were able to use, something that wouldn't work in the US?

I think that it's pretty universal that you can't not leak private information to the public unless it can be argued that it's for the good of the public.
And TrustedReviews most likely can't claim that they didn't know that the information they received was private, or argue that the information is important for the public to know.
Unless I've imagined hearing it, jim derpling's jimquisition video says that what's rumoured was that it was stolen information/materials, TR knew it and published it anyways.
Which kinda explains their silence on the whole deal?

Actually they didn't know the source of the leaks, a few ex-employees confirmed this.
The notion that it was "stolen" seems pretty unlikely to me. I would guess there was an employee sending this info to multiple sites (supposedly other sites decided not to run the story) and Rockstar found out who it was - probably because one of the sites ratted them out. Now while the employee would be on the hook for breaking NDAs or other contracts, that should not affect TR directly, as they had no contract with Take Two. The only thing I can think of is that perhaps TR made some exclusivity deal with the leaker, and that ties them legally to the breach of contract.
