If we are talking about using the same actor then it sounds incredibly stupid to me since his solo Spider-Man movies clearly do not take place in the same continuity. So if they abandoned those plans, good, I'd much rather have it this way.

Marvel agrees with me. They don't want Garfield as Spidey and they want Sony's Spider-Man movies to be considered non canon.
It also makes sense why Sony wouldn't want that. Who would want to watch a Spidey 3 with Garfield after Marvel's own Spidey marks him as non canon?

Let's simplify things here and not take into account any additional factors, how in the eyes of Sony Pictures execs ASM2 was worse than Guardians?
Hollywood still mainly cares about domestic gross, in that if it performs poorly domestically it will be a warning sign for them. Domestic only accounted for 28% of the gross for ASM2. Not saying they didnt make money but mixed reviews and a poor domestic showing is gonna cause concern for dumb studio execs.
And guardians was a completely new and, to many, unknown franchise. Spiderman is one of the original staples of comic book movies.

We'll just have to see it play out in January, I'm *hoping* Sony starts working with Marvel, or just relinquishes the rights altogether, but egh.. probably won't happen. I don't know but his contract ends June 2015 so he would need to renew it. And he also likes making lower budget stuff as well (movies, TV) which he might not be able to have time for if he continues to direct Avengers and be a Marvel consultant.
Especially since Avengers 3 has been split to two movies and it would be a big commitment.

Don't forget, Stark also has Spidey But that's largely the point... in this storyline, Stark/Vision/et al are the effective bad guys. They're the ones pushing for mut... *cough* "Enhanced Humans" registration.. which is most definitely a bad thing. You'll often find in most comics/films that the "good" guys are usually underpowered or outnumbered versus the "bad" guys, so it's about that kind of triumph of overcoming those odds.

And how do you know this? So far everything I've read/seen/heard has been very similar to the original storyline; an incident happens, the government enacts registration for all superheroes, Tony Stark is pro-registration and Steve Rogers is anti-registration. I've seen nothing that hints at "reporting to the government in a post-SHIELD world"
This is the Civil War of the Cinematic Universe, which will be greatly inspired by the "Civil War" of the comic universe, but we have a very different continuity going on. It has made the governments of the world say “we need to have some oversight of these guys. They need to report to somebody. So it becomes more… it falls under that umbrella, rather than “you have to take off your mask.” It’s not about the secret identity thing, as much as it is about, overall, who reports to who, and who can agree to oversight committee. Because as of now, in Avengers 2, there is no more security council, there is no SHIELD, obviously. Stark is paying for it, Captain America is running it, and things occur that will make governments begin to question.
