Well I kind of got screwed on EBay...here’s the story...
I bought a camera from some sly person on EBay. {This was the first time I bought anything from EBay...total NOOOB]
The description on this person’s auction lists the camera as in MINT condition, with no mention of this scratch on the lens.
I paid a good price for this camera! Otherwise I would let it slide a little easier!

So as a first time Ebayer I have come to you my fellow Nforcers for help...what do I do?

I know I probably can't get my money back so...this leaves some strategic moves for me.

Do I post a negative comment {as it’s the first time this person sold anything, but this person has a very good buying record} so I could damage this so someone will think twice about buying off of this person again.

The problem lies as this...If I post a negative comment about this person, this person will post an automatic negative comment about me...even though I paid with in a half an hour of winning this bid, so I did my part...so I really should get a positive, but hey you know that won't happen.

Another problem is being a first time ebayer; it would look bad on me to only have a negative comment for my first purchase. I do want to sell too.

So is there anyway I could get around things...like make a new account somehow. I really want to leave a negative comment for this person. But without burning myself!

Could you post the auction number or a link?

If you don't sell on ebay don't worry about your feedback. Only sellers care about that.
but since you want to sell, get a new acount.
And yes, your money is gone, the best you can do is e-mail ebay with a dispute.

You can just get a new account with out any problems.

and what can Ebay do about this if I use the dispute option?

you can file a dispute if you want... or you can leave him negative feedback, then when he leaves you negative just add a follow up saying its a retaliation and report it to e-bay. His feedback should be revoked. It's kinda long winded but it'll work.

Also what's wrong with contacting the seller and then pointing out it has scratches? Most power sellers aren't arseholes about it although 1 time I had a bad experience and for me to return the item back to e-bay woulda cost me more than it was worth.

I just posted a negative against a high seller and ebay called me up the next day, and tried to convince me to change my negative feedback. of course I didn't. If you go to the help section there must be a way to do the same against this person.

change your name and address a little. Use an alternate e-mail, for a new account.

Trust me I contacted her and she said that there was no srcatch when she sent it and she had the nerve to say that it could have happened in my pocession.

The very first thing I did was check the lens, no brainer...+ Its not a suface scratch it inbetween the two lens so...that leaves out a shipping problem and I.

shes not a power seller first time for her but she buys alot

A few extra spaces, and names spelled a little different will look like you are a different person.

New e-mail for sure.

I tried to resolve by contacting her, but she was basicaly pissing in my face so I left a negitive comment
which reads BWARE SELLER DECIVING camera arrived with scratched lens +false warranty claim

She claimed a 2 year warrenty but its registered to another persons name and a serial number...she will not give me the name...but big deal I can't use the warrenty anyway. I'm sure they will know its a different person when I shipped it back to them. So thats a lie.

+ the scratch on the lens...BUT on her auction it says the camera is in PERFECT CONDITION

Dude, u have pics of her faulty product? She obviously lied in her product description so she sold u something under false pretenses which is illegal (i think). She is totally in the wrong...email ebay customer support or whatever division handles shit like that, send ur pics, send the link of the product description...end of story. And when she does do something to retailiate, inform CS before hand that she mentioned she would do something like that and they should be able to handle it for you....

Seriously, its like me saying Im selling a perfect condition PS2...u get the product, and the lense is all scratched and u cant play games....yet thats ur fault? naw man, put this whore in her place...u didnt do anything wrong, she provided a fraudulent description of the product and that is illegal, plain and simple

just forward the e-mails / messages to ebay when you write your complaint. It will take a few weeks to sort out but you can ask for a refund, discount etc. But you must stress you want postage paid for by the seller and it refunded in full otherwise you might be stuck paying a small amount in postage fees.

How did you pay for it...? Paypal..?


I filed my second dispute about 3 months ago and won ... had the money back in my account about 2 months later so don't assume you won't get your money back.

I sent them all my emails too...Ha I was so professional in my emails, I never swore at her. If you would have seen my emails I was more than fair...but I was a honest and upfront about everything.

Here?s the deal

I'm going to take a bunch of rolls of film at different focusing ranges and in different light. {Like the guys on the forum suggested}
Now If I find nothing wrong with the pictures. I will be satisfied. And will leave a positive feedback. {I don't know why I should because I feel like I have been deceived. by the facts you stated in your auction, about the camera's condition, along with the warranty I will not be able to use!!!

If I find consistent problems with the same markings on the photos I will leave a negative feed...but before I leave a negative feedback, I will talk to you before I do, to try to come to some kind of an agreement.

I think I am being more than fair and level headed .If I paid $30 dollars for the camera we wouldn't be having this discussion. I paid over $200 for this camera.
I think this is fair and don't want to be in this position...but facts are facts...that?s how I see It.


After this email she basicly said I was harasing her and she was going file a complant and leave a negative comment.

I'm a first time ebayer this will look very bad for me because I want to sell and buy...so I decided to act first.

Ok best thing to to do now is leave it at that for a whle...let paypal get back to you and just follow the dispute as it proceeds along...The fact is the seller has to prove it wasn't damaged when it was sent..you havn't got to prove anything.. Smile


If you decide to sell on ebay i suggest getting seperate buy/sell accounts..you can make as many accounts with the same credit card as you want as long as you use a different email....Don't worry about the negs on the buy account.

You sir need to get your money back, not telling there is a scratch on the lens is not allowed in netherlands law. I dont know whats the american but i know for sure in holland you can get your money back and even go to the police and complain about fraud/flessentrekkerij.

OK she left me a negative comment heres what it reads

BEWARE!, horrible buyer!, tried to deceive and harass me, complains over nothing

Ha ya complains over nothing...I love this...Camera has huge scratch on lens + she gives me false warrarnty claims!!! Man I hope Ebay gets my money back and bans here.

I sent Ebay all the emails, they'll know I didn't try to decive or harrass her.

How do get this retracted...should I just wait for EBay to notify me about this investigation!!!

it should auto retract.... in your profile you can leave follow-up comments on feeback recieved / left. You can just say something like 'invalid warranty and a damaged product isn't what I wanted'
I think when you get your money back (which you will) the auction will be nullified anyway.

Your negative feedback is there to stay unfortunately unless you do a mutual withdrawl with the seller (Which you obviously don't want to do)...Ebay will not remove it even if you win the complaint.

They canceled an auction on me, SHIT. I was bidding on a IBM T43 and they just canceled, I hate ebay.
