Tough one...
For myself, between bioshock infinite, tomb raider, and ac4 I have to go with infinite. It stood out to me the most, I loved the plot, the gameplay, art direction, atmosphere...it was all there for me.

I went for AC4. While I didn't play all of the games on the list, of the ones I did play, I enjoyed AC4 and Tomb Raider most I think. Neither games are perfect, but I definitely had fun playing them.
Not done with AC4 yet but I did finish TR. I think AC4's theme just pushed it over TR a bit for me.
I just couldn't get into MLL as much as most people here. I used to think that if you didn't play an FPS on PC, you weren't a "PC gamer". I don't really believe that is the case today, however, and I hope I don't have to turn in my PC gamer card hehe. I'm more of an RPG player (always have been) and it's amazing to see what this year will be bringing to that genre. (i.e. wasteland 2).
Edit: Just noticed something. Starbound, that's still in "early access" right? If so, why wasn't Wasteland 2 tossed up there? Just not enough votes/popularity? I would think that unfinished games wouldn't count?
I apologize if I'm missing something though since I know there were a few disclaimers in the original post and that's fair/fine but I might have misunderstood.

I can't believe I forgot to mention Witcher 3. I should turn in my card just for that haha. Seriously, I just had a mind blank when I made my other post and WL2 was first that popped into my mind. I'm freaking drooling over TW3 here as well!
I backed Pillars, too, so that's on my list for sure

Good list!
Ass Creed for me. I loved every minute of it, it was the most memorable for me, and those sea shanties will be stuck in my head for months. Plus, PIRATES, I mean, come on, this is nforce.
I wanted to pick starbound but its an unfinished game (still better than most games, that says a lot)
I'll wait till its fully released before I vote for it in any best of polls (unless its best beta)
Bioshock, Tomb Raider, and Metro were all great, but too short.
I'm still working my way through Batman.
Battlefield 4? really? really? REALLY? no.
I need to finish Walking dead season 1 before I install season 2
The rest I didn't play.

And it has nothing to do with what I think should be on that list, but what deserves to be on that list. But as always, it's the popularity contest and the big popular games will always win it.
Edit: As always, I choose my words badly. It does have to do with what I think should be on that list, course, it does. What I meant to say is that it doesn't have to do with what my favourite games of the year are, which is not the same thing, as I for one, do find some games really good, but I don't like to play them.

Infinite, no contest.
Not in terms of gameplay - but in terms of the overall experience.
The shooter gameplay was nothing special, though I don't think it's as bad as some people seem to think - but it's definitely not the great part of the game.
To me, immersing myself in the exploration of the beautiful levels, the convincing Elizabeth NPC and the wonderful story was the best part of the game - and the ending was extremely powerful.
Most definitely the high point of 2013 in terms of gaming.

I didn't say none of them are worthy to be on the poll, I just won't vote for any of them because they're not my GOTY. However there are a good few there that I do believe shouldn't be there. At the end of it, I do actually believe there shouldn't be an overall GOTY, on any site, not just ours. I think that should be left to each individual to have his / her own list. Having one winner for each category is fine, but I came to the realization that putting all the eggs in one basket as it were is a really stupid idea.
