1. You can nominate 5 games maximum, but you can nominate less than that.
2. The points the game receives are based on its place on your list, for instance, 1st place gets 5 points, 2nd place gets 4 points etc.
3. The final 5 games are going to be put in a poll on January 1st, 2014, and the final poll will decide the "winner".

Nothing I've played this year has been truly disappointing, I guess I simply don't have any real expectations, game is what it is although since I barely follow development or watch media and other footage I'm not that hyped for anything either.
EDIT: X-Rebirth perhaps if anything, maybe because it's so recent that I remember it best but it could have been a lot better.
(Total War: Rome 2 had some issues as well but Creative Ensemble have made large improvements to the game now, maybe Egosoft can do the same given time, there's already a bit of progress.)
