Haven't had a vacation in forever, since I was needed, apparently. Now that the project has a free week, everyone on my team got a few days off. Come today, the first of day off, I get a call. "Yeah, so can you come in on Monday? There's this new project that's coming a bit earlier, it would be great to have you here" Can I at least say no? I really need these days off. Apparently, no, since there aren't enough people.
I'm really tired of this fuckery, I can barely see straight or have a decent conversation without groaning because I'm just too tired.

Pretty much, yeah. I told the guy I really needed this because I'm exhausted but he simply said "look, we need you, okay?"

I certainly hope so, I have 30 days, I think. Some from last year, and the rest are from this year. Today is basically my first day where I can stay at home in forever.

That sux man, but look at it from the bright side - you don't loose your vacation days.
Here if you don't use them during the year - you loose them.. (they pay them to you as extra working days).
Before the law got implemented I had ~70 days of vacation.. now I got 10 to the rest of the year

You have to talk to your employer soon then. Ask for vacation.
Some years ago I worked 6 days a week + few nights inbetween for a year and a half and eventually it all came down on me. I was THIS close to being hospitalised. Blood pressure spiked, concentration problems and I also got a very short trigger for all kinds of situations.

After a bunch of years we get around 7 weeks vacation I think.
Anyway I cannot say no to people when they call so if work calls and i know it's for overtime I just don't pick up...unless I get redlined (which is ur situation, not enough people blabla) in which case I'm fucked.

we have horrible shit in italy, but if you are a regular tax payed employ (good luck finding/keeping one ATM), you can work usually no more than 40h/week and 5-7 weeks of vacation time at year.
but yeah some people, even with that job, can get in your situation pretty easly and even with many over-hours at week (ranging on 50hrs/week ) all NOT payed.

Well, the thing is, it's either letting them make you their bitch, that means you will be the first in line everytime they want someone for the rest of your time in that job, or you grow some balls and take gamble with the possible outcome of being jobless.
I know it sucks... but one has to wonder how these "other guys" are always pulling it off. Maybe you should start to get into the brown-nosing business. I can't think of any other explanation for their success.
Btw, that's exactly why I stopped owning a cellphone. I didn't want to be their bitch too... not for that money. Especially when I already was on my friggin vacation (days off). I just didn't pick up their calls anymore when I had my days off.
Businessmen play dirty, that's why they're still in business. So you gotta start playing dirty too. Sucks, but such is life.

that's fucked up? how about working without the boss actually paying the taxes of your job? pretty common here in italy to work in "black".
of course, you can't refuse/complain if you want that job and there are tons of people willing to take your place if your are not willing to do it.
at least the food is great here.  |

Aw, I know this situation even too well as you can imagine. So many times I've had to do work overtime just because "hey please guys, let's do this, it's important! it affect our future!" when the high management was only taking advantage of us. It's really demoralizing, because there's so much competition that you can't afford to refuse, that would mean losing "virtual points" and you would only end up being demoted at best.
It's really time for a change though, at least for me, I'm prepared to send 'em to hell.  I'm always helpful and available but I'm not dumb, being a pseudo-slave ain't my thing, really. I shall regain my freedom very soon, that's for sure - a future (happy) unemployed xD

Uh, the limit is 60 hours, not 40. 40 is just the norm. And it's not 40 days vacation time either, it's 20 - for a 40-hour work week. 4 times the contractual work hours per week; so if you work five days a week, 8 hours a day for the standard 40-hour week, that means 20 days. I don't know where you got your numbers from, but if those are your rights you've got a pretty darn good CAO. What you said there are not the legal limits by a long shot.
@ Claude: I was in a similar spot. The trick is to plan a proper holiday well ahead of time. Plan it at the end of a project, notify them well up front. That's the only way I got it  |

It's just 20 paid for most people. That's all you're entitled to when you have a 40-hour work week.
Most companies and sectors also have something added for special occasions (weddings and what not), but none of that is legally required.

You got to be smart and not give them the chance. Tell them you'll be away on a trip for a week and if they call you, don't answer your phone. If they ask why you didn't answer your phone, tell them you left your charger at home and it went flat. There, problem solved. You're welcome.
