This is because Ubi has a stupid system where the game is only activated and added to Uplay during/after the installation process, so you need to get an installer from somewhere at first. Doesn't have to be Capsule, but they will provide it.
Once you have installed and activated it, you will be able to re-download it form Uplay whenever you want.

Ah okay, i didn't know that. So the only way you can download a game directly from uplay for the first time is when you buy it in the uplay store?

Yeah, that's the one step that would simplify things greatly.
But it seems there is a way to get the game straight into Uplay - if you buy the game from the shop that is inside the client itself.
Right now there is the UbiShop available through the browser, and the Uplay shop available through the client. They are completely separate it seems - I don't even have the same games available in different stores.
Edit: Seems they cleaned things up a little during the week. Used to be that certain editions were available only in one of the stores for me - not so any more,

Llet's say that you bought the game on Steam, if you want to play this game without the steam client, you need a retail or UbiShop key.
It smells scam.

Yes. But any other game that you buy via steam(Excluding SteamWorks titles, ofc) allows you the play withouth it. A GFWL title binds your key to your GFWL account, but Uplay binds it to it's "steam side". That said, if you want to play outside steam you need to buy it, even for the Uplay account that already has the game through steam.
I tried to lend my Uplay account to a friend of mine(He wanted to test MP), and it asked for a serial.

havent really been following this at all, seen a few pictures of installers and people with the game and as far as I can gather this aint steamworks.
so anyone fill me in if a release is poss?

I suppose you can if you use a crack or something, otherwise even non-steamworks games will still launch Steam before running.
I think the point is that even if you do bypass Steam, you still have to deal with Uplay, but games bought from Steam are not actually added to Uplay, so you can't get around it. Don't know if that's how it works, but apparently that is what trashci is saying.
Regardless, I'd hardly call it a scam though. For the most part, if you buy a game from Steam, you expect to make it work through Steam, not without it. If you want something else, you use GOG, for example.
I do recall Origin accepting Steam keys, allowing the games to be used that way, but since EA was/is promoting their software, it was understandable.
Now I think it's part of that new agreement that EA didn't like - Valve is not letting the publishers bypass Steam to provide the games and additional content directly. Everything needs to go through Steam and this is how Ubi made it work, while EA simply abandoned it.
