Well, I think the reason why they ban for ANY changes to the files is due to this game involves real money trading... Meaning anyone can profit from the game. So they're just playing safe.
In WoW, there's also real money involved, but not officially. It's against their rules to trade services for real money. So they can offer modding capabilities.

Once again; DarkD3 doesn't change any game files.

Good for you. Now fuck off.

I won't play without it. The stock game is a blurry, indistinct, washed-out mess.

DarkD3 itself doesn't give any advantage, but there are wrappers+injectors that work the same way which can actually be used to get an advantage. Most online games will tell you that you cant use any injector for this specific reason, even legit ones, as a safety measure.
Now the good news is : even tho asking the question "Can I get banned for using this?" is always answered with "Yes, it's against our rules", it never happens.
It seems like they only tell you that you can't use them as a way to cover their asses, but don't actually enforce it.
Looking at the wow forums, people have been using fxaa injectors for a long, long time without getting banned.
Since Diablo 3 should be using the same anti-cheat system as wow (Warden) I don't expect people to get banned for using it, tho it's impossible to be sure until the game launches.
With that said :
- It's still stupid as hell that, officially, it's not allowed. It's simply frustrating.
- I would personally wait before using it and see if others get any warning or ban first. Even tho playing the game without the sharpening filter may be painful.
- I've been undecided about buying D3, and this doesn't push me toward buying it. DarkD3 on Medium/Normal felt much better than the default look of the game. Default game still looked nice, but this just felt better.

this is made to prevent criyng like : hey you botted 24/24, ban.
no, i actually sharp filter the game 24x24.
ANY tampering with game memory/process (no matter the reason), in case of online gaming is banable offence, beign that ultima online, or call of duty. you may not get banned, but is a banable offence. is not blizzard crapy rule sudently, and is not diablo 3 either. and is not about rmah either. deal with it. is not like memory print of dark 3d is a unique one, and it canot be used to hide something else.

sc2 says hi.
lots of people who map hacked in mp, cheated their ass in campain for achievements, got their account banned. or in the best case, the whole achievements disabled for the account.
yeh, using cheats in sp campain, got your account banned. it sucks, but is no way limited to diablo. and is the same blizzard.

Thanks m3th0d, but there's no point trying to reason and use logic with trolls. He's frankly not worth my time =)

The problem isnt the filter, but the injection method. This way any cheat/hack could use "allowed" injections to cover its identity.

So now we're not allowed to make graphical improvments on the game we bought?
I was on the fence on buying the game or not because of the whole must be online thing, but this takes the cake.
And makes my decision a lot easier. Gonna give my money to Rockstar instead.

p.s.
i can understand you sabin, i just tried to explain why is that banable.
i used all the versions of filters in beta, but no matter which one, after 2-3 h of play, it become annoying for my eyes. the only one i could see me use, was the sharpness one, but still after every game session i returned to original blizzard art.
and when i played on my phillips full hd tv, i could just set some effects like it from my tv menu.
no chance to get something remotly like from video drivers, right ?

If EA/Ubisoft/Activision does it, it's evil. If Blizzard does it, it's necessary to hold back cheaters.
@Sabin: did you use sme special settings or something to get that screen? The improvement I got wasn't that dramatic. Sure looks a lot better like that.

Everyone actually said it was shitty, simply explained the reason why behind the decision, which is a decision shared by almost every online games.
It's possible to understand their decision and still believe it's shitty. Doesn't have to be one or the other.

He's right Yondaime, I'm sorry, but he's right and there's nothing you can rationalise to change that fact. Ubisoft has "always on" restrictions on their games and you people kick off royally .... Blizzard does it and suddenly, magically, hilariously, it's accepted? Not only that but people DEFEND the decision as well! If Ubisoft said you couldn't use inject_FXAA or FRAPS with Assassin's Creed, people would hit the fucking roof and there would be outcries galore, people screaming for the head of Yves Guillemot.
Like I said; hilarious. Love those double standards.

I don't agree with the argument that doing something right makes it OK to do things most people here think is the devil's work (always online DRM, no offline mode for people who don't give a shit about MP, making money out of the trading of virtual items, banning graphical mods etc.). Why is such DRM bashed in every single thread yet here it's OK? Why can't I use GFX mods if I think the game looks very oudated? Oh wait, it's a Blizzard game so GFX suddenly doesn't mean shit. Why does Blizzard get such a big percentage of the trades? Oh it's Blizzard's game, not yours (what a retarded argument btw) and keeping up servers costs billions. Why can't EA ban people from their SP game, yet it's OK when Blizzard does it?
