Not sure I get it, so if the game is running from the dvd the USB has to be plugged in the xbox the whole time for the update to work?
Yes, the update is running of the System Cache on the USB. No matter if you run the game of the DVD or HDD, you can't take out the USB (if you do the game asks you to put it back).
There is no way to "copy" the update over to the HDD of the USB. If you want it on the HDD, you need to hook the HDD itself up to your PC with a connection kit.
For me it's no issue, I always have a 16GB USB drive connected to expand on my small 20GB HDD to allow me to install more than 2 discs.
So if I can't plug it out it means the update is working.

Remember tho. YOu will have to reformat YOur usb if You will put there more than ~25 updates in cache folder.
The pendrive will become unreadable and will need to be reformatted. Its a problem with Xtaf bugging when having more that 25 uodates at onec in cache folder.

Im on PS3 firmware 3.41 jailbroken and this game only works with 3.55 cfw at the moment. Because I dont want the hassle of updating to the cfw, can I buy the original game and play it without updating to to official 3.61?
Also, should I perhaps update to CFW3.55 anyway? Would I lose any compatibilty with games Ive already got running on 3.41 (hacked 3.41 eboots etc)?
This game owns. With that I mean it's different. Don't want all games to be this story driven and (somewhat) linear), but it is very nice for a change. An adventure game for the 21st century.

Does solving cases wrong(like accusing wrong guy and having low ratings) affets game story?
I am loving the game so far, but feel like I am playing it mostly wrong. There is plenty of replayability and I am sure going to finsish it againg and again in order to have real endings to all the cases. 4 cases to go. Should do it today.

Guys those who played this, would you say it feels like a noir GTA? I kinda thought red dead redemption felt like a western gta, looking forward to this but I'm somewhat tired of the gta type game with the mandatory cutscenes before each mission.

if they hadn't used this motion face capture this game would be on the list of the worst games of 2011

It's nothing at all like GTA, there are no missions. PLenty of cutscenes though.

i will say this , if you liked Hard Rain you will like this one
the thing here was i started to dislike this game when
you had the right items to get the right guy but your forced to fail

the other thing that was also mentioned here was how those cases or rather those clues where given to you,
how you ask , by LUCK ! i can understand your a lucky guy that has the luck of finding the right guy ONCE but when you find all your suspect in every single case by luck, oh officer he looks like this guy , oh detective he sits there behind you , oh hi you killed him [chase scene]
you just go mental ,
game looks nice , has great animation but thats not what a game makes
this game would be a GOTY :
if those conversations would have real dialog options then just LIE button , DOUBT button , TRUTH button
if those cases would not have those retarded out of the blue sudden luck findings , they should be more detective like combining clues to find stuff

if you could be a bad cop that was good , you can't intimidate/hit/bribe suspects only use goody two shoes i have the evidence to lock you in jail
I just skipped all sidemissions after disc one.Don't press A during the dispatch call and you are golden if you insist on driving to caselocations yourself.
If you let your partner drive everywhere the dispatcher won't announce the sidemission to begin with.
