PostPosted: Tue, 15th Mar 2011 04:59    Post subject: Another ebay situation...
I sold a GPU recently. The thing was overheating but it functioned fine though. I tested Crysis 2 demo and it worked fine but it kept reaching temps of like 105C...

I tried replacing the thermal compound but it still overheated. So then I decided I dont have time to figure that crap out and I sold this GPU on ebay as-is. So for the condition of the item I put "For parts or not working: An item that does not function as intended and is not fully operational. This includes items that are defective in ways that render them difficult to use, items that require service or repair, or items missing essential components. See the seller’s listing for full details."

Also my return policy is "The seller will not accept returns for this item."

So the retard who bought the GPU thought he could fix it by replacing the thermal paste or something (nub). He got the item on Saturday and now he wants a refund because apparently theres a tiny little mark on a transistor on the back of the card. And so he wants a full refund because i "didnt describe the item accurately". I told this guy it was sold as-is with no returns and it functions fine.

This mofo opened an ebay case against me tonight! What a turd! I got this email a few minutes ago:

Quote:
eBay opened a case in the Resolution Center because ***** has a problem with an item purchased from you.
In most cases, buyers and sellers can resolve these types of issues through direct communication. We encourage you to respond to this case by Mar 21, 2011. If you aren't able to work things out, you or the buyer can contact eBay Customer Support to review this case and make a final decision.

Details the buyer provided:
Problem: The item is not as described
The buyer has already contacted you through eBay Messages
The buyer paid on Mar 04, 2011
The item is damaged
You have responded to the buyer
You aren't working with the buyer to solve the problem

Additional information:
"He said that there were no returns, I explained that the item did not match the description and he never responded"

The buyer wants:
A full refund

So I immediately escalated the case to ebay support so its all in their hands now. What are the chances of me winning this case? I know ebay is usually super lenient towards the buyer and not the seller

You'll win. eBay almost always side with the seller, since that's where eBay make the money; seller fees. You'll also win simply because you specifically stated it was sold as-is as "faulty: for parts"

Don't worry, you'll win.

.... but this still begs the question; how the fuck are you destroying so much hardware? Shit man, you ain't getting within 10,000km of MY rig Laughing

Lol I didn't destroy it. I purchased the card used from ebay like 2 weeks ago. THAT seller sold the thing as "barely used".. Rolling Eyes

So after I got it, it worked but kept overheating. I opened it up to see what was going on. The dummy used a tiny bit of arctic cyramique compound to cool a damn fermi chip.... So I applied the proper amount of MX-2 and reseated the heatsink but it still overheated. Also, some of the grease thermal pads were missing when I opened the card. I just didn't have time to order new thermal pads.I also stated in my auction "So I am lead to believe that the previous owner either had a waterblock or an aftermarket cooler on this card"

I just didn't have time to deal with that thing so I sold it as-is so I can get a proper working one

I would never buy parts off ebay, too many problems. Sometimes brandnew hardware doesn't work. Seriously, how much money are you saving? I could be missing something?

It depends. Sometimes there are some amazing deals on ebay. The video card in my PC (http://www.evga.com/products/moreinfo.asp?pn=015-P3-1489-AR) retailed for $649 at the time I purchased it. Now its actually just hard to find. I purchased it from a seller on ebay for only $350

Has been working like a charm ever since. I use ebay mainly for selling though

Yes, but since PayPal is owned BY eBay .. if eBay rules in favour of the seller (TC01 in this case) then the same will generally apply to PayPal too.

You should win as it was advertised correctly Parts only. Ebay is great to save money on! Just do your research and make sure what you are buying. Stuff like Video cards I would only buy new on ebay-in sealed box.

Hmm well this fucking sucks. I wonder if I can open a case against the asshole who sold me this card in the first place as "barely used"

EDIT: just opened a case against that fucker:

Quote:
Details you've provided:
Problem: The item is not as described
You have already contacted the seller through eBay Messages
You paid on Feb 17, 2011
The item is damaged
The seller has not responded to you
The seller isn't working with you to solve the problem
You entered the phone number of "34*****6"
We can share your phone number with the seller.

Additional information:
"The seller said this graphics card was "barely used." After receiving the graphics card, it immediately began overheating. So I thought perhaps its just an issue with the cooler. So I decided to sell the card "as-is" on ebay because it overheats. However, it turns out that the graphics card has more problems than just damaged cooler. There is missing transistor on the hardware and the item's core voltage regulation is completely messed up. I would be more lenient towards these issues if the card was sold "as-is" but he sold me this card as "barely used". I strongly feel that this seller has conned and tricked me into buying hardware that is obviously faulty. He did not specify any of these issues. Just stated that the card was "barely used""

You asked for:
A full refund

Lol

NO FUCKING WAYYYYY!!!

The seller replied to my case:

Quote:
Seller's message:
"Hey man, I'm sorry if the card wasnt working. Had no idea.. As soon as you give me tracking I'll refund you. so sorry. thanks!

HOLY SHIT Laughing Laughing Laughing Laughing Laughing

Yea man Im so relieved. At the end of all this, everybody is happy. My buyer gets his money back and then I get my money back. I also sold it for exactly the same amount as I bought it for ($200). So $200 will leave my paypal account and then $200 will return back to my paypal account

I definitely learned my lesson

Aye, it's safer to just stay clear of buying pre-owned, high end, PC components on eBay. It's just not worth the risk ..... though I am VERY shocked eBay sided with the buyer rather than you. That was... unexpected.
