I thought DX11 was just an update to DX10.1, so you won't get all the enhancements from 11 unless you have a card which supports it. But you will still get the features from DX10.
Or am I not getting something?

its probably just gonna be some rudimentary tacked on dx11 support anyway. Just so they can use it for marketing purposes. Oooh we use teh dx11, yaaay. The gamesindustry hasnt even really caught onto DX10 at this point, there is support but its in no way really taken advantage of.

Nah, DX11 is *supposedly* a huge update to DX10, adding compute shading and other goodies like tessellation.

Games like Unigine benchmark (Well not a game, hah.) and Battleforge do work under DX11 mode on DX10 and DX10.1 cards like my 4890 but they will revert back to whatever support is added as with Battleforge that's SM 4.1 and DirectCompute 4.1 and for Unigine SM 4.0 and DirectCompute 4.0 as you need the hardware capabilities of the GPU to enable SM 5.0 (That's shader model btw.) along with proper tesselation (Different from the tesselation possible, but never used, on current ATI hardware like 2000 series to 4000 series.)
It also can't use the full Direct Compute 5.0 (Back to 4.1) which limits OpenCL a bit but ATI does allow beta support for it anyhow via http://developer.amd.com/gpu/atistreamsdk/pages/default.aspx (Or other places but registration is quick and free.)
For games like Dirt 2 and probably AvP 3 you only get DX9 functionality, I keep saying it's a promo title for AMD (Kinda like Cryostasis for NVIDIA and PhysX.) which I guess is sorta true so to give a better "perspective" on what DX11 can do compared to "older" hardware whereas if it also supported DX10 (Like Call of Pripyat or Battleforge.) you would only gain (The only major gain that is, unsure about SDK specifics.) tesselation and direct compute 5.0 (And some other stuff like better multi-threading and programmable shader improvements similar to DX10's geometry shaders used in for example Crysis for shadows, but disabled normally, or Lost Planet for fur and stuff.)
Bit hard to explain so sorry if the post is a bit messy, I'm not 100% sure about DirectX and such since I don't use the SDK and other technical stuff so most is taken from articles and previews which might be a bit inaccurate or biased.
(ATI for example promotes tesselation but as seen in Dirt 2 you get close to a 50% performance hit with ultra details due to all tesselation on that crowd so it's not perfect for such heavy usage.)
EDIT: I guess CoP also benefits a bit from DX11 via shaders like tweaked shadows and SSAO or rather the HDAO mode with Direct Compute to assist it plus the obvious massive speed from a 5870 or similar card.
(Or the mid-range 5850 or even 5770 on lower resolutions.)
(Although HDAO works on DX10 and tesselation for it is rather ugly you do get a larger performance hit, especially once those sun-rays come up, and those are pretty hefty as is in terms of performance cost due to the engine being so shader heavy.)

There can't be a release until 16th feb because there are some files missing I guess (like the .exe).

If it's a Steam required title and it works like other retail games you get those archives and a installer that starts Steam, asks you to log in and then add the CD-key and then it copies the contents from those archives over to Steam (As a sort of preload.) and decryptes them, key files (EDIT: Numbers.) for decryption was available last week but are no longer listed in that clientregistry.blob file from what I can see but it should be back around monday or so.
You also get the usual Steam check so if some European gets the game early he might not be able to play until Friday the 19th. (US releases normally on Tuesdays with EU releases normally on Fridays for some odd reason that probably has some explanaiton, haha.)
Being able to extract the files properly and decrypted won't help much though as (As you said.) normally the EXE or other core files are downloaded separately to prevent just such a scenario that could lead to a early leak.
Also the game could use other stuff as well but I have no idea what.
(I know it uses Steam and LIVE which isn't a major problem and if it uses that new system a offline key should still work for playing solo but it could also use SecuROM or similar for activation on top of this which would make a homemade rip nearly impossible and would need a proper crack first, probably works like Bioshock 2 then as a launcher for the main game exe.)

What do you mean with LIVE? GFWL? Because I don't think it supports GFWL.
Well, like you said, I don't think there will be a release before feb 16th.
Everything else is propably fake. The only thing I could imagine is using the .exe of the demo.
Who knows if that works.

I've seen some stores where they carefully open the plastic and remove the disc. And sometimes you end up paying for an empty case too.
