That's because they generally come from PartnetNET, which is developers/publishers only and where they test/release XBLA titles before shunting them to retail networks. Hell, I remember Alien Breed 2 leaking before Team17 had even ANNOUNCED it. That's one of the reasons 360 XDKs are so sought after; live PartnerNET access.
