then my xbox silver ring law suit = we won = finally new drives
after that my xbox crippled functionality
Eu courts allways are against monopolist tactics of M$ so another WIN hmmm

Where did i say something like that? If MS loses in the court, that makes their actions illegal, right? So obviosly MS doesn't do everything legal, cause they lose sometimes and pay fine or compensation. BUT that doesn't mean they don't do everything possible to avoid lawsuits, especially massive lawsuits you can expect when you ban 1 mil of people, is it too difficult to understand? |
It's too difficult for him to understand, you might aswell give up. The rest of us get what you are saying though. MS knew fine well that they were going to be banning a massive amount of users from LIVE and that they were going to be removing the ability for these hacked consoles to install what are more than likely pirate copies of their games to their HDD's, so like you, I'm 100% sure that they had a whole team of legal experts pouring over the finer details for months before they pulled the trigger. But hey, what do they know? Sabin says they're wrong and that what they have done is illegal and that they are about to be ass raped in court so he MUST be right!.
MS are surely quaking in their boots right now 
And just why Sabin is so infatuated with the HDD lockout not having anything to do with LIVE is beyond me. What the hell does LIVE have to do with it? They are 2 seperate things entirely.
MS do not want you playing on LIVE with copied games so they ban you and prevent you from accessing the service.
MS do not want you playing copied games full stop, they can't disable the DVD drive on said consoles without rendering the machine useless, so they do the next best thing and stop you from installing your pirated games on the HDD.
The two are unrelated! and they are well within their rights to do so.
All of you whiners really need to stop crying about this and suck it up. From now on you'll need to play your free games from discs. Get over it already!

Making full functinality disabled on the HDD is bricking. Cant install games on HDD, putting HDD to another console then get all files corrupted is bricking. Theres even poeple who got all their licences removed...for games games/songs they actually bought.

1) They haven't removed full functionality. You can still create save games and save previously existing save games.
2) Bricking is breaking. If they bricked the HDD then you would not be able to use it on a different console. This is not the case. Your HDD will work perfectly well on an unbanned console.

Maybe its wise you do some investigation first to see if what they do is wrong , let me remind you on one thing they might get sued for timing the ban waves not the hardware issues.
So be the first Sabin and go sue them , you seem to know everything so go for it sue them and strike millions of us dollars that aint worth crap so maybe best to sue them in euros.

Well my thought also on this.
When you buy any stuff in the EU legally its yours.
What you do with it it doesn't matter and no one has ever the right to ban or change hardware parts of it.
Its like buying a 100 inch led tv, drill a hole in it and fuck your tv with curtains close.
YOU OWN THE 100 inch led tv and if you want to drill a hole in it and fuck it, thats allowed in the EU.
Its a rule and I like that rule.
I even had a few years ago the same discussion with someone of the law on that about modding my wii. Said the same thing, you can safely mod with a wiikey, but downloading games, movies music and play them on the wii is against the law.

Because back then you only got banned from their live service?
And also I would like to add this about arcade games. The two most recently bought games work, Trials and shadow complex, while all the others dont. This is becuase my 360 was sent in for repair and therefor I must be logged in to be able to play those. So if it wasn´t for m$ bad product to begin with I would still have all my arcade games.
Knowing how easy they brake, maybe I have to buy a new one eventually anyway.

Thank god someone else has some brains and can understand. Nobody is suing because they got banned from Live, that's the risk everyone knows and takes, and only the pathetic little cunts are whining about it -- what people are annoyed about is the loss of functionality that doesn't relate to Live itself. You buy the console, it's yours to do with whatever the fuck you want. Period. If you mod it, you get banned from live, you shouldn't also have some nameless fuck at MS send data to your machine that cuts its functionality in half! That's illegal tampering.

I agree that when you sign up for live you enter a contract, the legality of the contract needs to be looked at, your best bet if you mod is to stay off-line "no new knowledge" but they should be able to ban your present account and modded console and void of warranty not other purchased software, but then again you agree to the contract so it will be up to the courts.....
