To be honnest, i have no fuckin idea. I am Mr. Extra Carefull,
- Always had the lattest firmware.
- I dont burn games before it pass verification in abgx
- I dont play games before street date
- I go on live only when im going to play multiplayer like cod 4 and cod 5.
- When i play single players, i unplug the ethernet cable.
- After playing a backup, i run a original game to remove the cache of the backup before going on Live.
- I dont put my gamercard as a sig or avatar on sites and forums.
So im totally clueless on why i got my console banned.

When i started my 360 and went on Live, a big window poped up saying my console is banned for violation of terms and theres no recourse for the ban so beeing permanent.

It's pretty hilarious that you would go through all these steps when there is no proof whatsoever that they help to avoid ban, no one even knows how MS bans. Gotta love how everyone has their own made up "anti ban" rituals which, as you now clearly see, are utterly pointless.
Don't get me wrong, I feel your pain, it sucks and all, but at the same time it's ironic.

You'll be the one feeling the pain when they link the serial number of the returned 360 to your gamertag. Probably not a wise move.
Also, now that I think about it. I'll probably be banned again soon. My gamertag has to be flagged with them by now as during the xbox 1 period I was banned atleast 3 or 4 times by forgetting to switch my modchip off before going on live. And then once with the 360. They must take things like that into account.
EDIT: It's also strange that there doesn't seem to be anyone else online reporting being banned in recent times. Maybe it's the start of this years ban wave.

and guess what, mine's not banned. one important fact though: my xbox live gold membership ran out before i flashed my 360 and i never renewed it since then. maybe playing online is the deciding factor?

Anyway, if I do get banned again then I'll just give into them and buy an arcade and leave it unmodded for use online which is probably exactly what they are after. It more hardware sold in the end.

If you play on Live alot and/or download stuff from it and MS bans you, you'll most likely buy another console (profit fo MS) and you will probably even start paying for games you play online (more profit for MS) to avoid another ban. So yeah, it's pretty pointless to ban people who don't use Live, they'll just keep playing single player games like they did before ban

But I really can't see them taking that point of view myself. It's not like they have to go out of their way to ban you. All that they need to do is add your console ID to the revoked list so you would think that they would ban you regardless of your live activity as a matter of course.

It's not that hard for them to check logs to see how much you like Live. They don't gain anything if they ban you from Live which you don't even use. If you don't use Live and they ban you they'll lose you as a customer forever. If they don't ban you though there's a chance that you'll start to play on Live someday and become addicted, THAT will be a good time to ban you.

Once again, you are just speculating...
Your theory is flawed. People who play online buy Gold memberships, they sometimes even buy DLCs, so banning them is a mistake financially. If you think that every banned person who played online will just run and buy a new console you are very mistaken, it's very likely that person will never buy another console to play on Live again. And that's less profit for MS right here.

There more you use live, the more you get addicted to it, that includes buying gold memberships and DLCs, it's a very good sign you like Live very much. And yes, it's just a theory, it's not like i work for MS to know for sure.

MS made a point about modded controllers awhile ago as Infinity Ward have been working on a solution. I think there only intention was a small ban as it breaks the T&C's of xbox live.
The way I look at it, MS seem to only ban once per year for the space of what, a forntight. I use my xbox a lot therefore its £160 per year for a console and a gold membership. Thats about £14 per month ( or 5 pints of Guinness). They could ban me every year and I'd still replace it.
The whole ABGX, I use it to check the stealth and thats it. So what if it isn't verified. Verified by whom? Considering we don't exactly know the criteria for being banned then its all guess work anyhow.
MS won't trace back gamertags to new consoles and banned consoles. Its not in their interest to. I suspect they'll literally look for reoffending consoles and flag them as being banned. It would become costly to develop a tracing system with so many units on the market, many with multiple gamertags.

This might sound harsh but I dont really feel sorry to those that get banned , they know the risk involved in this still its not the end of the world the box still works and they can still play games but if you wanna play online then people should imo not flash.
The funniest are the ones that start to yell names at microsoft when they get banned.

This could very well be the case ... i also played the french odst and they warned people for it. ( scare tactic ) But they did not catch me ( it might happen later tho ) as i know a few people who have been caught ( but they only got a warning for it btw. ) It seems not to matter if you played a lot of backups nor if you went online with it. ( just banning randomly )

I have 1.41... I haven't played online in forever, I usually only connect to live with no disc in tray to check out demos and such... after applying the latest update a few days ago... yesterday I tried to connect to live and it advised me that I was banned... Anyone else got banned lately?

Was that ever mention that everything start massively after the October 28th update??? I look daily in every threads and didnt notice anyone talking about that. Ive been suspected that update for a week now.

I was banned on Saturday, oh well, I dont care, I didnt use live anyway, just had a silver account, can care less about being banned..will get my drive flashed to 1.61 then I can play the wave 4 games I have..Microsoft can go screw themselves..I still have my games

It's not really all that stupid. What if the check is actually incorporated into the OS itself? The console might then detect the firmware and wait until it does get connected to live in the future to report it to MS in which case it might be banned shortly after.
I've wondered about this myself. I have a new flashed elite that has never been connected to live, but I have uploaded achievements gained on the new console by connecting the HDD up to a different xbox 360 which BTW has now been banned. For all we know, it may well be that MS already have my new serial number flagged for a ban even though it has never been connected to LIVE directly.
