with the newest firmware
that can,right now,"fool" their System and not getting banned,
right?

fuck MS, I have been using modified firmware for two years now (updated irregularly), playing more than 80+ backups etc. Been playing before street date as well. Gold user for all of the time, otherwise spent 0 on live
Only thing what I did, I never played bad rls of game...
I do not remember any topics or posts at xbox-scene regarding banning firmware only mods (w/o played backups).... As well I dont recall any information about possible method how MS could detect modified firmware...

Let me think a bit. Hmm Canadian, US etc. guys playing french release (potentially bad one) . What is the probability of cheating?
If french guys are banned (with proper release) maybe then I would start to consider that MS can detect a shit

Let me get this straight.
so they don't ban you just because you have 360 with FW,
they ban you because you played backups on your console{when they detect you}
and if you playing "good release"{for example?}
there is a lower chance to get banned
am I right?

I'm 99% sure I've read about people who have had modded FW's, but only played originals, and they were banned on the last ban-wave..

I read it over at Xbox-Scene when the last wave had just struck. Look it up yourself and you'll find it. It was in the thread were they collected info on the banned 360's, wich FW and how they played games (only offline, only retail games online, etc etc)

My xboxlove account is still ok & console not yet banned,although I have not played ODST on my unbanned console yet,I played ODST on my current banned xbox360 & logged the 1st few achievments,put the hard drive into my unbanned machine to play SOME BATTLEFIELD Online & ok so far,not gonna use ODST in my unbanned machine only in my unbanned machine,Its not like you can play mulitplayer anyway?,
having read that MS are likely only to be banning accounts rather than machines,if account is banned couldnt you just set up another live account & be away playing backups online again,I know you may lose DLC from the old xboxlive account so if this is case i wonder if there doing this as if they ban consoles people may just say screw MS I'll just pop out & buy a PS3 slim now they have reduced the price & not bother buying a new xbox360 to get back on live that way they will have a banned xbox360 still be able to play copies ofline & play online with there PS3 for free,just a thought why they may have changed stategy now sony looks like it is gaining some ground in pricing

wouldn't it be logical if someone from MS would post such notes to scare everyone...
You are basing your opinion of rumors, I am basing it on facts, that myself and noone of 5 other my mates for whom I flashed their consoles and who have played only good releases are not banned....
empirical evidence vs. rumors....
