if her name's on the contract, the company that sold it won't do much, i guess.
threaten him with the cops or get a few friends together and get it back (if you do this make sure to rough him up/scare him a bit so that he won't feel inclined to pursue any sort of vengeful shit).

I think this is the police' job, no? If you can prove that it is indeed hers, you could have a case. But I don't know, if she gave it as a gift and now suddenly wants it back... If it was something she bought for the both of them, and now wants it back, you are on the right side. If she bought it for the ex as a gift, it's vague.

thats the problem. Shes getting into debt because of it. It WAS bought as a gift, but the fucker got violent with her and took everything when they split. I am so tempted to go around to his house (its only a 15 minute walk from here) and fuck it over but I dont want to have to suffer any legal shit over a damn TV.

So I should go to the cops then?

there's no way to tell whether it was a gift or not, it's her word against his.
i don't think it matters, though. gift or not, it's her name on the contract, so it's her tv.

the company doesn't care who has the tv. they only care about her paying every month.

if the guy's not much of a gangsta or smth, i'd say go get him. but that's only 'cause i wouldn't feel that comfortable having to go to the cops, so i'm biased. if you don't have that sort of problems, then by all means, use the legal system Wink

Still, I think, and I guess Saint could elaborate, even if something is yours, you can't just break into a house (or charge and threaten to beat) in order to get it. You must use the proper channels.

good points raised, i already spoke to some friends of friends who can damage his house/car and all that stuff but in the end its not worth it. We need the TV back so I can pay it off, that is all. He can go fuck himself and die for all I care, I just want that TV back so I can get it over with. Im not really up for going around to ask for it but If if comes to that after we try legally then fuck it I guess Id have to get some friends to come with me as this guy is quite a mean mofo.

How much are these payments a month? If its under $100. Then you should evaluate the situation.

If he is the kind of person that is violent with a woman, he may give you some backlash even if you just get the TV back. Do you really want her ex in your life.

I just say this because i had a similar situation with my wife's ex. He had a TV stand (Very nice one, solid wood, etc) that he refused to give back. He was still trying to phone her and shit when we got together, and every time she would bring up the TV stand, he used it as an opening to phone her again, and get in our lives.

At the end of the day it wasn't worth it.

Pick your battles

I know far worse people than he is capable of befriending and they owe me many favours; Ive worked in the pub trade for a long time. If need be id get some one else to do my dirty work and 'shut him up'.

For now, we are planning on writing a letter to this guys father, as he himself wont respond to anything we send. If his father does not comply either were threatening court action.

if the guy is violent, i d consider bringing in legal advice before doing anything. Because chances are that you re either getting into something you dont want to or that he rather destroys the tv if you do it on your own.
Do you know any lawyer? (Students often get free legal advice through their university, if you know one...)

edit: you could also try to talk to him and tell him that the name of his ex is on the papers and that you re paying for it right now and that you want it back. And tell him, that if he doesnt, he ll be sued for theft.

Inform the police that he stole it. Since you are paying for it you should have no problem having proof that you are the owner or that is on lease to you. Why should you get your hands dirty. Otherwise I'd phone the lease company and inform them of the situation. Just say that you will stop paying unless the property is returned and they will call the police.

Apart from that I don't understand why are you managing the luggage of your girlfriend. Her TV is her problem. Her ex is her problem.

I think you have to take him to small claims court. It was shared property at the time they were together but it depends on whether it was a gift or not. He will get notified of the court date and it he doesn't show up then the case defaults to you/her. Then if he still doesn't give it back the police will go over and get it. You can bring up his violent past in court too and request the police to go with you which is prob a good idea because they make good witness if he sends back a trashed TV or makes threats.

You don't need a lawyer but it will cost you a small fee to go to small claims.

WTF @ all the bad advice.

Don't mess with a man's ride. Some prick just broke the glass shield on the instrument panel of my bike last night. Bastard also broke off the side mirrors. That's not cool. Especially when I think the guy who did it is the ex of my brother's girl, and it was my brother who borrowed it last night.

Also WTF at just beating the guy to get the tv.

Most of all DUBYA TEE EFF at actually assaulting him with a weapon.

Just... gah. This will not end well. He's going to do something in a similar vein, or will go after you legally. Either way, you lose.
