Comcast's bandwidth limitting and peer-to-peer traffic sabatoging traffic finally caught up with the company. A class-action lawsuit has been filed (PDF) by residents in the state of California against Comcast.

About time, they dare to sell people a "high speed" (sic) subscription then they restrict its use without people knowledge to everything that won't use the bandwidth that they have paid, mainly coz they are too lame and don't want to invest in building up or expanding their infrastructure, what a scam.

Justified class-action lawsuit, but probably won't hold because judges and juries are too scared to appear pro-piracy (yes, yes, I know p2p is not only about piracy, but let's be real).

A judge is -supposed to be- here to apply the law, in front of such scam and breach of contract the "oh-look-we-steal-you-to-counter-piracy" argument would be grotesque, if comcast try to go this way they won't make shine its PR. Just looked at Comcast TOS and nowhere limitations over P2P are mentioned, only Web/FTP hosting.

I don't agree with throttling P2P, but all the idiots on cable that upload at full speed piss me off. Having to share a connection with someone who does that is HELL, it destroys the network, basically takes you down to 56k speeds.

You should try living in the UK. The internet is awful here, the speeds are fast and say "unlimited" yet when you download more than 700mb in peak time you get your bandwidth sliced in half for the remainder of the night.

A bit OT mate, the problem is not with throttling, the problem is having the ISP doing so for you -without your knowledge and against your interests- to fit its needs which are basically to limit its investment in its network to be able to make more money on your back while you still pay for the advertised bandwidth and terms of service. You can throttle your shared connection all-by-yourself to suit your needs (can't really remember but netlimiter or similar should do the trick).

The top rung service, XL (20mbit), will see users downloading over 3GB in peak hours (3pm - 12am )having their downstream speed restricted to 5Mbps, and 256Kbps upstream."

if you break the 3gb limit 1 minute before midnight you still get capped for hours on end aswell Laughing

gotta love unlimited isps that let you use your real bandwidth for 15minutes before cutting your balls off.

btw this is meant to be an upgrade from 10mbit that had no download caps or stupid limits lol they pretty much just downgraded everyones service

i'm hoping that the residents will win the cause.
i'm really pissed off when someone sells something and then you discover that you don't have what u thought to have bought.
if i buy a 4 mbit ul / 256 mbit dl connection i just wanna be able to use that bandwidth ! and if there are limitations i want to be informed before signing the contract !
if the sellers is not able to give me what he is selling it's his problem not a client's one !

imho it's wrong when they justify themselves with the classic phrases "some users are using too much bandwidth", hey but do they listen to what they say ??? i buy a 4 mbit 24 hours / day connection and i am "guilty" of using it @ 100% ???

why they don't sell connections with clearly conditions as:
- you will have a 4 mbit 24 hours a day line that you won't be able to use it always because if there are too many users we will cut everyone connection up to the point that we can give everyone a fraction of what they bought
- we can limit without even telling you some bandwidth expensive programs so don't even come complaining for that

fortunately in my country (at least for my isp) the situation is globally not perfect but quite good, nonetheless those california residents do well to suit their isp

get be*, unlimited transfers and up to 24mbit unthrottled speed.

Sure, I agree, but I'm just saying if a judge/jury find for the plaintiffs, than they might come out as in favor of piracy, and for some reason judges/juries fear of that.

Comcast blows.

Ever since they've taken over Time Warner cable in Houston my service has been UTTER SHIT.
In the past 2 days I was without internet for 16 fucking hours. The humanity....

Seriously though, these fuckers are monopolizing.
I'm forced to pay $60 for 6Mbit down/ 40KB up. Fucking extortion, but its my only choice Sad


I can never be free, because the shackles I wear can't be touched or be seen.

I just switched from Time Warner Cable back to AT&T as they are offering Fiber in my area now. Some shit called U-Verse 10/1 for the highest bracket package. They are suppose to be bumping it up another 2-5 early 08 to compete with TW - since this area is TW territory AT&T are bending over backward in attempt at gaining cusomters back.

So far so good.

outside of their towelhead support, AT&T's service is good, outside a few disconnections every now and then I've never had a problem in the 4+ years I've been with em (at&t > sbc > att&t sbc) 25$ a month for 315KB/s down and 51KB/s up.

Weird. My friend seeds about a 180 GB a month on AT&T. Hasn't even gotten a letter yet. He says he doesn't give a fuck; his dad's a retired lawyer who takes other people's cases for free in his spare time, so he wouldn't mind fighting for his son if the RIAA ever came knocking Smile
