You can get free "legit" key from Microsoft here. Then download Win8 en_windows_8_x64_dvd_915440.iso (you can find download links here) and load it up in Windows Integrator. Then use its "Convert Windows 8 Professional to ProfessionalWMC" feature to create Win8 Pro with WMC, you can even integrate the key you got from MS earlier so you don't have to retype it at installation. Still in this program you can create the ISO or make bootable USB install media. Voila you have "legit" Windows 8 that will be activated after installation right off the bat.
There may be other ways, but this has worked for me great.
As for your second question I don't know what's "someone like me". My guess is though that you don't really need it. And unless you like getting used to new stuff (few stuff is done differently in Win8) and tinkering with it, you won't benefit much from getting Win 8. I like it more than Win 7 after I got used to it and after I installed Start8, and now I wouldn't go back to Win 7 as my main OS. But I still keep my Win 7 installation on second disk just in case of some incompatibility, or something.

I rather have one that is working and activated without having to check it every xx months and reapply it (unless i got that info wrong from this KMS server shit)

That is true. But what are the chances Microsoft will deactivate these copies? Free WMC upgrade is available for people who bought it. Upgrade will replace the key, can they distinguish these activations?

Well, i gave creating this image a try, but i just cannot find that "feature" you are talking about

IE shows the original KMS client key. But I doubt MS will deactivate

Well on Win8 now, but already pissed off.
Can't seem to get downscaling to work 
This worked without a flaw in win7, why not here?!

And SweetFX doesn't work in combination with fraps... I'm going back to Win7... SweetFX is a MUST for me..

Because i have used fraps for years and gives IMO the best raw quality.
I don't see why it doesn't work with fraps while it does with DXTory..

Well regarding quality I think it comes down to what codec you use. You don't have an option with Fraps if I remember correctly, but with DxTory you can choose something like Lagarith Lossless codec and set to capture in RGB color space. This way it should be pretty much same quality as input (source). Anyway one of the best advantages DxTory has over Fraps is that it doesn't reduce FPS to whatever framerate you are recording to.

You can unlock the framerate, so it doesn't stick with the fps that you are recording with

Good, didn't know you could do that. Last time I used Fraps I couldn't find way to do it.
Anyway there are still couple other advantages it has over Fraps. Like not splitting up files to 4GB parts, plethora of recording options (so you have control over resolution, codecs, etc.). Personally I don't record often, but when I do I use x264 crf21 ultrafast profile with zerolatency to get pretty good videoquality at reasonable size.

DxTory is indeed superior in every way. Less impact from recording, even with straight encoding to x264. Quality wise it depends on your settings obviously.

You can do that now aswell with fraps btw 
But i'll give dxtory another try and see if i still not like it, but i'm forced to use it anyway untill fraps fixed their issue with sweetfx

That might be, but on 1080p it's not doable, on 720p yeah. But i want my vids to be 1080p, and straight encode will rape my rig even more

Same here, yet in most games my framerate goes below 60 already when recording raw footage at 1080p..
My rig should be capable of frapsing at 1080p and have 60 fps atleast
