BTW I just checked the system requirements and they're identical to those of DS1. That's nice, I liked very much the lighting in DS1..

No. As it was said before it's most likely impossible to crack DS2 before release date similarly to many other games that use release date checking mechanisms.

Nah.. Sceners would never care about the quality of a title.. they just want to release as much as stuff as possible. In fact they would prefer to crack HAWX2 over some other title to boast about their skillzzzzz.
Ubi DRM will take some time to figure out how it works. Nothing to worry about as it has happened before with other protection schemes. The good news is that it affects only Ubisoft's internally developed games, since they don't offer this protection to other publishers.
