Nobody with a spark of intelligence could dismiss the fact that it's a blatant rip off of Batman.
As much as I hate the whole movie industry I can't, scratch that, don't want to believe they'd just let something like this slide.

You kidding right? Why would they sue them? Not like they are in a competition. And technically, there has been no copyright infringement here. Otherwise, you can make a case that anyone in tights and pointy ears costume is a Batman ripoff.
