I have the same issue actually. But there's going to be a patch released that solves the tearing issue in darksiders, and i would like to download that patch if i'm not banned.
A bit offtopic perhaps but i was wondering if people are still getting betting at this moment for going online with 1.61 and am i probably gonna be banned by next november? in other words is it 'safe' to go online for now. (i know its not safe in the long run but i got a new xbox360 and wanted to use it for offline anyways but well if there's no banwaves anymore i might as well use online for now)

Well I also wanted to do it to download the patch for darksiders. I registered the box now and I don't get a service unavailable page. But still it's quite risky... Don't know if i should do it.

Well the simple question is: Can the 360 be "banned" and hard-drive crippled just by doing the live connection test? Or is that only possible if try to sign in to live?

Oh yeah i got that, it's just i play the backup's on my banned console with my HDD attached. Then put the HDD on my legit console to play COD online and update my score..
My Console wasn't officially banned (didn't get the ban message) so my HDD isn't corrupted.
An easy REAL way to know if you are banned is to call MS and ask them if this serial number is banned like : "i wanna buy a second hand 360, but i'm sure it's banned and it's a con" "do you have the serial number ?" "sure, here it is" "too bad it's banned, don't buy it"....

Show me proof/source of it not working. I have one banned box, service unavailable. Other box not banned goes right to next step. Lots of people are reporting that it works.

Nobodys answer but the answer is, yes, you get banned.
Its exactly what I did (the connection test) and it does ban you and remove HDD installations.
The thing is, if your not willing to connect to live to find out if you've been banned, then does it matter if you've been banned anyway as you're obviously not using XBL? HDD installations isn't all that, we lived without it for 2 years.
