yes and no, installing the update will not ban your console if you stay off Live but it will be banned if you sign into Live at any further point from now if you have used non stealthed images in the past

staying off-line and being unbanned is like being banned and staying off-line anyway
point is if u banned u are banned, there is nothing u can do
personaly played on-line only copy of GOW for an hour or so, others were original and i still have old fw and connect to live regulary, mainly to check demos and stuff
