Is it copyrighted?
I say no. A friend says it is.
Solve the argument.

Copyright dies 150 or 100 years after the person dies
It's free to the public then. You pay for cd's tho.
But it isn't copyrighted.

Not 100% sure but it shouldn't be as the copyrights expire after 50yrs or so here in the UK. So unless anyone else buys the rights for another 5oyrs, then no.

Quote: | A creative work is protected from the moment of its initial fixing in a tangible form through the length of the author's life plus an additional 70 years following the author's death. In cases of a joint work, the rights endure for 70 years following the death of the longest surviving author.
The "70 year rule" allows an author's family or beneficiaries to collect royalties even after the author has passed away.
Due to changes in copyright law in the past, different rules apply to works created prior to January 1, 1978. Different rules also apply to works made for hire. |

If its atleast 50 year after the composer died, then so does its rights.
edit: ask TheSaint, he's a lawyer.

I listen to classical music 50% of the time, it's just pure genius.
I think that the music in itself is right free, but a record or a copy of a sheetbook is prohibited, because SOMEONE had to play this music, record it, make CD's and such...
So if you download a song, it's still illegal I think...

If i'm not mistaken the notes are not copyrighted, but the music is.
Which means, it's illegal to copy the music but it's legal to copy the notes.
After all someone had to play this music, publish it on CDs and etc..

Classical music is pretty much timeless. I know alot of people who like it, in the right situations of course.

when you buy classical music, you are paying the artist, not the composer (obviously). it's the musician who you are defrauding if you download.

Yes, it is copyrighted. The music you hear on CD's was not recorded 90 years ago.

as some others tried to state already, it s a mixed bag really.
There is no copyright in itself on the music, so as a musician you are free to play and/or record and sell it anyway and anywhere you want.
But if you want to "use" newly recorded classical music, you lll have to ask the people who recorded it.
Same goes with the original score. While it is ok to reproduce some or all of it, you arent allowed to completly copy and redistribute a full book that has been published by somebody else.
And often you cant get the original score without going to the heirs of the work of classical composers to get to the sheets.
