Nope. They have to be brought to the court, use that excuse/defense and get away with it and THEN there will be a precedent for everyone to use the same excuse. Until someones brings them to court and they manage to get away with this excuse, it means nothing.

as far as I know,they basically stopped with their IP tracking for suing people,and it was ineffective from the Start.
