Only used my 120gb hard drive on my old xbox360 to play mw 2 on it, and when i play orginal games i put my 120gb back to my elite!
Now my elite is banned, and my old xbox not!
strange things happening here :/ |
Was your banned elite flashed? |
Yes it was flashed with 1.6
but i never used a copy on it! |
Why did you flash it if you only played originals on that console? Seems very silly

No, his console was banned because he flashed it. MS doesn't ban consoles that aren't flashed, it was said million times. And for early play they temporarily ban gamertag, not the console.

A friend of mine just got banned but he never played back ups, only originals as his xbox got flashed only 5 days ago and his order of 50 dvd-dl hadn't arrived yet and while waiting he only played borrowed originals. And of course using the latest fw 1.61. So c4eva can say whatever he wants that flashed fw is not detectable as it obvious is ... at least the 1.61 are. I only wonder what fw is detectable and how of course. I'm not banned yet f.e. using 1.4 liteon fw and patching all dvds.

did he flash his own 360? it possible that the guy who flashed the 360 played some backups.

No because i was there when his drive got flashed and he didn't want to borrow burned games of me because i patch them and play everything ( review copies etc ) and he wanted to be very careful. I told him about the ban-wave which was going on but he was too eager to buy one.

They don't damage your hardware. The HDD will still work perfectly well on an unbanned 360 once you recover your gamertag. All that they are doing is removing a feature. |
And by recovering the GT, you lose what exactly? :-\ Besides, even using it on a banned 360 is fucking despicable. You break the T&C of an online service, and suddenly they cripple the abilities of the entire - rather expensive - hardware? No, there's no way that's legal, especially as chipping is NOT illegal in the EU. |
Even if chipping was illegal, no one is chipping their 360. We're simply updating the firmware and there's no way they'd be able to outlaw that. However, to remove functionality, such as Windows Media Centre, which has been part of the 360 since day 1 is ridiculous and legally questionable. If they can do that, then what is there stopping them from bricking the 360 completely? Imagine if it worked but every time you inserted a disc they just threw up a "Disc unreadable" message at you.

You lose everything. But I think that it would be rather difficult to argue your point in a court of law considering that you have modified the console with the intent to use it to play "backups" regardless of whether or not you actually legally own the games that you are using it to play. I'm pretty sure that copying even your OWN games is againt the T&C of your licensing agreement anyway which could be used by MS as a counter.
But anway, getting back to reality, no one is going to go to all of that trouble and go up against the most powerfull company in the world for the sake of installing 360 games to the HDD on their console. |
Microsoft are the ones who've 'banned' you and crippled the functinoality of yuor machine so surely the onus is on them ro prove that you've modified your console? You could simply flash back to default firmware, replace the warranty sticker and then claim your machine wasn't modded. How would they prove otherwise? We've all seen how they refuse to even discuss why people are banned so I can't see them revealing this in a court of law. Although it might be one way to try and get the information out of them. If they're going to accuse you of something and cripple your hardware then surely they have to provide proof of these accusations otherwise jhow is it any different to hacking into someones PC, corrupting thweir data and crippling the hardware?

First of all, my 360 is NOT banned.
Secondly, if you have a lite on, you CANNOT flash it back to the stock firmware.
And thirdly, there is no recourse for a console ban. If your console is banned you cannot send it in to MS for repair or for them to check and it will not be unbanned whether you flash it back to stock or not.
