So you admit Apple is a market re-inventor/creator?
They are allowed to because they haven't been challenged. It is exactly the same as Windows RT allowing native IE10 full Win32+WinRT API access, while marketplace applications only get the limited WinRT API access. It's despicable either way.

They cannot ban it, because that is the device that the manufacturer has offered for sale. When you agree to the EULA you agree to be anally raped by them. What they did decide was that it's not DMCA ( ) defying act and is not illegal in the USA ( ). This is a big step too.

Dude, there's no way to tell if it was opened or not, so no. Just put the original battery back in before sending it in for the warranty issue. Chances are though that your warranty will have expired by the time you've worn out the battery.
