Because it's Apple and they can pretty much do anything they want to. Apple gets away with shit that would put MS out of business thanks to nonsense rulings in the EU. I guess Apple isn't opposed to greasing a few palms...

So you admit Apple is a market re-inventor/creator? 
They are allowed to because they haven't been challenged. It is exactly the same as Windows RT allowing native IE10 full Win32+WinRT API access, while marketplace applications only get the limited WinRT API access. It's despicable either way.

like xbox or playstation they're closed systems with just one channel to run software

They cannot ban it, because that is the device that the manufacturer has offered for sale. When you agree to the EULA you agree to be anally raped by them. What they did decide was that it's not DMCA ( ) defying act and is not illegal in the USA (). This is a big step too.

Dude, there's no way to tell if it was opened or not, so no. Just put the original battery back in before sending it in for the warranty issue. Chances are though that your warranty will have expired by the time you've worn out the battery.
