They are allowed to because they haven't been challenged. It is exactly the same as Windows RT allowing native IE10 full Win32+WinRT API access, while marketplace applications only get the limited WinRT API access. It's despicable either way.

well, ios devices aren't really considered general purpose computers
like xbox or playstation they're closed systems with just one channel to run software
they should just ban all hardware locking

They cannot ban it, because that is the device that the manufacturer has offered for sale. When you agree to the EULA you agree to be anally raped by them. What they did decide was that it's not DMCA (Rolling Eyes) defying act and is not illegal in the USA (Rolling Eyes). This is a big step too.
